Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Fugoku Cloud platform, website, APIs, and related services (collectively, the "Services") provided by Fugoku Inc., a Wyoming corporation ("Fugoku," "we," "us," or "our").

By creating an account or using our Services, you agree to these Terms. If you do not agree, do not use our Services.

1. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at support@fugoku.com if you suspect unauthorized access.

2. Services

Fugoku provides cloud infrastructure services including but not limited to: virtual servers, bare metal servers, GPU compute instances, block storage, object storage, private networking, load balancing, and managed services. Service availability, specifications, and regions are described on our website and may change over time.

3. Acceptable Use

You agree not to use our Services to:

1. Violate any applicable law or regulation
2. Infringe the intellectual property or privacy rights of others
3. Distribute malware, spam, or malicious content
4. Conduct unauthorized network scanning, penetration testing, or denial-of-service attacks
5. Mine cryptocurrency without prior written approval
6. Host content that promotes violence, exploitation, or illegal activity
7. Resell or redistribute Services without written authorization

We reserve the right to suspend or terminate accounts that violate these terms without notice.

4. Billing and Payment

Services are billed according to the pricing published on our Pricing page or as agreed in a separate order form. You authorize us to charge your payment method for all fees incurred. Fees are non-refundable except as required by law or stated in a separate agreement.

We may change pricing with 30 days' notice. Continued use after a pricing change constitutes acceptance.

5. Service Level

We target high availability for all production services. Specific uptime commitments and credit policies, where applicable, are described in our Service Level Agreement (SLA), available upon request for enterprise customers.

6. Data Ownership

You retain all rights to your data. We do not access, use, or share your data except as necessary to provide the Services, comply with law, or enforce these Terms. When you delete your account, we will delete your data within 30 days.

7. Intellectual Property

The Fugoku name, logo, website content, and platform software are owned by Fugoku Inc. and protected by applicable intellectual property laws. You may not copy, modify, or reverse-engineer any part of our platform.

8. Limitation of Liability

To the maximum extent permitted by law, Fugoku shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity arising from your use of the Services.

Our total liability for any claim arising from these Terms shall not exceed the fees you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Fugoku, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

10. Termination

Either party may terminate this agreement at any time. You may close your account through the dashboard or by contacting support@fugoku.com. We may suspend or terminate your account for violation of these Terms or for any reason with 30 days' notice.

Upon termination, your right to use the Services ceases immediately. You are responsible for exporting your data before account closure.

11. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or through the platform. Continued use after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States. Any disputes shall be resolved in the courts of Wyoming, or by mutual agreement through binding arbitration.
